Terms of Service

These Terms of Service ("Terms") govern your access to and use of the AutoQualified platform located at autoqualified.ca (the "Platform"), operated by Cognis Systems Inc.("Cognis Systems," "AutoQualified," "we," "us," or "our").

By accessing or using the Platform, submitting a form, or interacting with our AI voice or chat agents, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Platform.

AutoQualified is a Canadian vehicle purchasing concierge service that:

• Provides a free, searchable database of Canadian manufacturer vehicle incentives
• Collects vehicle purchasing preferences and financial information from consumers
• Matches qualified vehicle buyers with licensed automotive dealer partners in our network
• Uses AI-powered voice and chat agents to assist consumers through the qualification process

AutoQualified is not a licensed motor vehicle dealer and does not sell vehicles. We are a lead generation and consumer concierge platform. All vehicle transactions occur exclusively between consumers and licensed dealer partners.

You must be at least 18 years of age and a resident of Canada to use this Platform. By using the Platform, you represent and warrant that you meet these requirements. If you are using the Platform on behalf of a business entity, you represent that you have authority to bind that entity to these Terms.

By submitting information through the Platform, you:

• Represent that all information provided is accurate, current, and complete to the best of your knowledge
• Authorize AutoQualified to contact you by phone (including automated voice calls, if consented), SMS, and email regarding your vehicle inquiry, subject to your consent selections at time of submission
• Acknowledge that your information may be shared with licensed automotive dealer partners in our network, as disclosed in our Privacy Policy and as consented at the time of submission
• Understand that submission of a form does not guarantee you will receive a specific vehicle, financing offer, or incentive amount

The incentive information displayed on the Platform is compiled from publicly available sources published by Canadian vehicle manufacturers. This information is provided for general informational purposes only.

• Incentive offers are subject to change without notice by manufacturers
• Eligibility for specific incentives is determined by manufacturers and dealers, not by AutoQualified
• Displayed amounts are provided "as of" the date shown and may not reflect the most current offers
• You should independently verify all incentive information directly with the manufacturer or a licensed dealer before making a purchase decision

AutoQualified makes no warranties, express or implied, regarding the accuracy, completeness, or fitness for a particular purpose of any incentive information displayed on the Platform.

The Platform uses artificial intelligence technology for voice calls and chat interactions. You acknowledge that:

• Every AI interaction begins with a disclosure that you are interacting with an automated AI system
• AI agents may not always understand complex or unusual requests
• AI-generated information should be independently verified before making financial decisions
• Calls may be recorded and transcribed for quality assurance and compliance purposes
• You can request to speak with a human representative at any time by stating this during any call or chat
• If you consented to automated voice calls (ADAD consent), you may revoke this consent at any time by emailing privacy@autoqualified.ca

AutoQualified is not a lender, broker, or financial institution. The following important limitations apply:

• Submission of financial preference information (monthly budget, down payment, credit range) does not constitute a credit application and will not result in a credit inquiry
• The credit score range you provide is self-reported and used only for dealer matching purposes
• No representation is made regarding your likelihood of approval for financing
• Any credit bureau inquiry requires your separate, explicit written consent and will be conducted by a licensed dealer or lender, not by AutoQualified
• Actual financing terms, rates, and approval decisions are made exclusively by licensed lenders and dealers based on their own underwriting criteria

AutoQualified maintains a network of licensed automotive dealer partners. You acknowledge that:

• Dealer partners are independent businesses and not employees or agents of AutoQualified
• AutoQualified is not responsible for the actions, representations, or omissions of dealer partners
• Any vehicle purchase, financing agreement, or other transaction is solely between you and the dealer partner
• Dealer partners are licensed by the VSA (BC), AMVIC (AB), OMVIC (ON), or applicable provincial regulator
• Your lead profile will be delivered to one dealer partner matched to your vehicle preferences and location

You agree not to use the Platform to:

• Submit false, misleading, or fraudulent information
• Attempt to manipulate, deceive, or prompt-inject any AI system on the Platform
• Scrape, copy, or systematically extract data from the Platform without written permission
• Submit forms for commercial data collection or competitive intelligence purposes
• Impersonate another person or entity
• Violate any applicable Canadian federal or provincial law

All content on the Platform — including text, design, logos, AI agent scripts, the AutoQualified brand, and the "Hank" mascot character — is owned by or licensed to Cognis Systems Inc. and is protected by Canadian copyright, trademark, and intellectual property laws. You may not reproduce, distribute, or create derivative works from any Platform content without our written permission.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE CANADIAN LAW, COGNIS SYSTEMS INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, OR DECISIONS MADE IN RELIANCE ON INFORMATION PROVIDED THROUGH THE PLATFORM.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATING TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED ONE HUNDRED CANADIAN DOLLARS ($100 CAD).

These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of British Columbia, Canada.

We may update these Terms from time to time. Material changes will be communicated by updating the "Last updated" date at the top of this page. Your continued use of the Platform after changes constitutes acceptance of the updated Terms.
